California Consumer Privacy Act Notice

This notice ("Notice") is issued by Silver Spur Commerce LLC, which trades as Incendio Fire Wand (IFW) and is referred to below as "we" or "us".

What follows describes the personal information we gather about residents of California, what we do with it, and who we pass it to. It also sets out the rights the California Consumer Privacy Act ("CCPA") gives those residents - among them the right to ask us to hand over the personal information collected about them over the preceding twelve months together with the details listed here, and the right to ask us to erase personal information we obtained from them. Nothing in this Notice applies to anyone outside California.

"Personal information" under the CCPA means information that identifies a particular California resident or household, relates to them, or could reasonably be connected to them. This Notice calls it "Personal Data".

Categories of Personal Data we collect

Personal Data reaches us through a number of different channels - supplying our products and services, running our employment and human resources functions, and working with independent contractors. Exactly what we hold on any one California resident depends on how we have dealt with that person. Across the last twelve months the categories collected were:

  • Personal identifiers - unique identifiers such as a full name, together with federal or state identification numbers including Social Security and driver's licence numbers
  • Contact details - name, telephone number, postal address, email address
  • Protected class characteristics - attributes protected under state or federal law, for instance sex or marital status
  • Purchase records - products and services obtained, and transaction history
  • Online activity - browsing history and records of how someone interacts with our sites, applications and advertising
  • Geolocation - device location
  • Audio and visual material - audio, electronic, visual, thermal, olfactory and similar records, such as recorded calls or video
  • Employment history - professional and employment information, including previous roles and employers
  • Education records - schooling and related information

Why we collect it and how it is used

Our reasons vary with the relationship in question. Broadly, Personal Data is used to:

  • Deliver and administer products and services - setting up and processing transactions, and keeping those products and services running.
  • Run day-to-day operations and meet risk, legal and compliance duties - accounting, monitoring and reporting; information security and anti-fraud work, credit checks, underwriting and due diligence; audits, investigations, legal demands and the pursuit or defence of claims; engaging service providers; and honouring our policies, procedures and contracts.
  • Manage and develop the business - marketing, personalisation and product improvement; research and analysis; customer relationship management; and evaluating mergers, acquisitions or transfers of all or part of a business or its assets.
  • Support employment, infrastructure and HR - administering employee and dependant benefits including healthcare and retirement plans; managing pay; operating our premises and infrastructure; processing job applications and contractor agreements.

Where the data comes from

  • California residents themselves, or people acting for them, on paper, by telephone, or electronically through our website and social media.
  • Public records and widely available sources, including media reports and records published by federal, state or local government bodies.
  • Outside companies supplying data for fraud prevention, underwriting and marketing - internet service providers, social networks, operating systems and platforms, data brokers, advertising networks and analytics providers among them.
  • Outside companies supplying data for human resources and workforce management, or to meet regulatory obligations.
  • Outside companies supplying data in the course of providing products and services, completing transactions, supporting operations, or business management and development.

Who we disclose it to

Again this depends on the relationship. Over the past twelve months the categories above were disclosed for business purposes to:

  • Outside companies and organisations, service providers included, bound by appropriate confidentiality and use restrictions, in connection with providing products and services, completing transactions, supporting operations, or business management and development. This covers internet service providers, social networks, platforms, data brokers, advertising networks, software and information system suppliers, analytics providers, organisations we supply, partners and financial institutions, and parties to mergers, acquisitions and asset transfers.
  • People and firms representing California residents - an accountant, a financial adviser, or someone holding power of attorney.
  • Government agencies, including for regulatory and legal purposes.
  • Outside companies supporting human resources and workforce management, safety functions and sales functions.
  • Outside companies involved in routine or mandatory reporting, consumer reporting agencies included.
  • Outside companies and organisations in connection with litigation.

Each category of Personal Data listed earlier may have been disclosed to any of the recipient categories above, according to the purpose involved.

Sale of Personal Data

The CCPA treats disclosure of Personal Data for money or other valuable consideration as a "sale", and gives California residents the right to opt out where a business sells their information. We provide no opt-out mechanism for the simple reason that we have not sold Personal Data at any point in at least the last twelve months. We also confirm, as the CCPA requires, that we have no actual knowledge of having sold the Personal Data of any California resident aged fifteen or younger.

Your rights under the CCPA

A California resident may ask us to disclose, for the twelve months preceding the request (an "Access Request"): the categories of Personal Data collected and the sources it came from; the business or commercial purpose behind collecting it; the categories of third parties it was disclosed to and what was disclosed; and the specific pieces of Personal Data held. A resident may also ask us to erase Personal Data obtained from them (a "Deletion Request"). Exercising either right will never result in discriminatory treatment.

How we handle requests

Much of the Personal Data we hold is governed by privacy and data protection laws other than the CCPA, and where those apply the data may fall outside the scope of Access and Deletion Requests or be exempt from them - information covered by federal statutes such as the Gramm-Leach-Bliley Act or the Health Insurance Portability and Accountability Act, for example. In those cases we may decline a request in whole or in part, meaning some data will not be supplied in response to an Access Request and some will not be erased in response to a Deletion Request.

Those statutes are examples rather than a complete list. Other CCPA exceptions may also apply: we will not hand over Personal Data about a different individual where doing so would harm that person's privacy rights, and we will not delete data we are legally obliged to keep.

Making a request

California residents can submit an Access Request or a Deletion Request by telephone on +1 (458) 257-2630, or by email to support@incendiofirewand.com. We will ask for information identifying you and will attempt to verify your identity, for instance by matching what you give us against other sources of comparable information.

Authorised agents

A California resident may appoint an agent to submit a request on their behalf; the agent should contact us using the details above. As part of verification we may ask for, as applicable:

  • Where an individual is acting for a California resident - the requestor's name, contact details, Social Security or individual taxpayer identification number, date of birth, and driver's licence, State ID or Matricula Card; the same details for the resident concerned; and a document establishing the requestor's authority, such as a power of attorney, a guardianship or conservatorship order, or a minor's birth certificate where the requestor is the custodial parent.
  • Where a company or organisation is acting for a California resident - the entity's active registration with the California Secretary of State; proof of the resident's authorisation, such as a power of attorney or a guardianship or conservatorship order; the resident's name, contact details, Social Security or individual taxpayer identification number, date of birth and identification document; and proof that the individual acting for the entity is authorised to do so, which we accept as a letter on the entity's letterhead signed by one of its officers.

Changes to this Notice

This Notice may be revised from time to time. A revised version will be posted on this page with the date it was last updated, and takes effect on that date. It applies to everyone who has used the site, whenever they used it, and to information collected before the change, replacing the version before it. Please look over this page periodically, and in particular before sending us any personal information.

Issues with the Heating Element

If you find that the heating element of your Incendio Magic Wand is not functioning properly after the initial test, please follow the steps below to resolve the issue:

  1. Complete Charging: Make sure your Incendio Magic Wand is fully charged. The charging indicator on the cable should illuminate green to signify a full charge.
  2. Check the Power Switch: Confirm that the switch located at the bottom end of the wand is turned to the "ON" position.
  3. Press and Hold: If the above steps are in order, press and hold the "FIRE" button for 3-5 seconds to see if the heating element lights up.
  4. Document the Issue: If the heating element remains unlit, kindly record a video showing:

Incomplete Set

If you believe that your Incendio Magic Wand package is incomplete, please follow the steps below to address the issue:

  1. Verify the Contents: Ensure that you've received the full set. Please note that the instruction manual is currently not provided in a physical format and is only available on this website.
  2. Document the Issue: Kindly take a photograph of the items you received.
  3. Contact Our Support Team: Share the photograph, along with a description of your order, with our support team at support@incendiofirewand.com.

Visible Defects

If upon receiving your Incendio Magic Wand, you notice any visible damage such as cracks, chips, or other defects, please follow these steps:

  1. Document the Defects: Take clear photographs or videos of the identified defects to clearly show the issue.
  2. Contact Our Support Team: Email the images or videos, along with a detailed description of the problem, to our support team at support@incendiofirewand.com.

Wand Ceases to Shoot

Over time, your Incendio Magic Wand's heating element might accumulate dust, soot, or remnants of burned flash paper. Here's what you can do if you encounter this issue:

  1. Gentle Cleaning: Carefully attempt to clear away any visible debris. You can delicately use a needle or cotton swab, ensuring you apply minimal pressure. Exerting too much force might damage the heating element, and in such instances, we may not be able to provide warranty service.
  2. Avoid Liquids: Do not use any cleaning solutions or water. These could harm the heating element or cause an electrical short.
  3. Soot Disposal: You might try gently blowing out any soot from the wand's nozzle.

Always ensure you handle the wand with care, prioritizing its functionality and your safety.

Prohibited Actions

Please refrain from any self-interventions or modifications to the Incendio Magic Wand. Actions such as gluing, prying open, soldering, or any similar tampering will void your warranty. Always prioritize the integrity and safety of the product, and if you encounter issues, consult our support team before taking any measures on your own.
