Welcome to Incendio Fire Wand. This website is operated by Incendio Fire Wand (IFW), a brand of Silver Spur Commerce LLC. Wherever "we", "us", "our" or "the Company" appear below, they refer to Silver Spur Commerce LLC. Everything offered here - the site itself, its information, its tools and its services - is made available to you on condition that you accept the terms, conditions, policies and notices recorded on this page.

Browsing the site or buying from it means you are using our "Service" and are bound by these Terms of Service ("Terms"), together with any further terms and policies referred to here or linked from here. They bind every user without exception: browsers, customers, vendors, merchants and contributors of content alike.

Read them before you use any part of the site. Using any part of it signals agreement; if any of it is unacceptable to you, you should not use the site or its Services. Should these Terms be treated as an offer, acceptance is limited strictly to their contents. Headings are there to help you navigate and carry no legal weight of their own.

1. Changes to these Terms

Tools and features added to the store in future fall under these Terms automatically. We may revise, replace or update any part of them by publishing the new version on this page, and the current version is always the one shown here. Checking the page from time to time is your responsibility, and continuing to use the site after a change is published means you accept it.

2. Eligibility and acceptable use

By accepting these Terms you confirm that you have reached the age of majority where you live, or that you have reached it and consent to any minor in your care using the site. Our products may not be put to illegal or unauthorised use, and nothing you do through the Service may break the laws of your jurisdiction, copyright law included. Transmitting worms, viruses or any destructive code is forbidden. Any breach of these Terms ends your access to the Services immediately.

3. Availability of the site

We accept no liability if incendiofirewand.com is unavailable, at any moment or for any length of time, whatever the cause. Access to parts of the site, or to all of it, may be restricted from time to time.

You understand that your content, payment card details excepted, may travel unencrypted, which involves transmission across various networks and adaptation to the technical requirements of the networks or devices involved. Payment card details are encrypted whenever they cross a network.

4. Product presentation and accuracy of information

Prices, images and descriptions are prepared with care, and we have gone to considerable lengths to show the appearance, colour, texture and finish of our products faithfully. What appears on your screen nevertheless depends on your monitor and your equipment, so we cannot promise that an image matches the goods exactly. Our Return Policy applies if a purchase disappoints you.

Material on this site is published for general information and we are not answerable if it proves inaccurate, incomplete or out of date. It should not serve as your only basis for a decision without reference to primary, fuller or more current sources, and any reliance you place on it is at your own risk. Historical material appears for reference and is by its nature not current. We may alter the contents of the site whenever we choose but are under no duty to update anything, and watching for such changes is your responsibility. We do not warrant that products, Services, information or other material you obtain will meet your expectations, nor that faults in the Service will be put right.

5. Placing an order

Orders are rarely shipped on the day they are placed. Preparation takes 1-2 business days whichever shipping option you choose, and we dispatch Monday to Friday, excluding weekends and public holidays - an order placed on Monday would normally leave us on Tuesday or Wednesday. A tracking number follows once it ships.

Every order placed on the site is subject to acceptance under these Terms. Products bought from us may not be resold on Amazon, eBay or comparable marketplaces.

An order may be declined for reasons including, but not limited to:

• the item ordered is out of stock;
• we cannot obtain authorisation for your payment;
• we have spotted an error in pricing or in a product description;
• a system or procurement failure has occurred.

When an order is placed we email you a record of it setting out the product ordered and the payment method used.

6. Sale and promotional items

Anything bought in a sale is a final sale and cannot be returned. If something is wrong with such an order or product, write to support@incendiofirewand.com.

7. Cancelling an order

An order that has not yet been dispatched can be cancelled for any reason by contacting our customer service team at support@incendiofirewand.com. Because we try to process orders straight away, stopping a dispatch is not always possible.

8. Dispatch and tracking

Once your payment clears we prepare the order, and a confirmation email follows the moment it ships, naming the courier and linking to the tracking number. Tracking pages can take 1-2 days to begin updating, and a page that stops updating does not mean the parcel is lost - orders usually arrive regardless. Where a delivery problem arises, contact the carrier directly through the contact details published on their own website, or write to us at support@incendiofirewand.com.

All our shipments carry tracking with delivery confirmation. Where tracking shows the item delivered to your order address but nothing has reached you, the carrier is the party to investigate, and we cannot be held accountable for parcels their records show as delivered to that address.

Entering the shipping address correctly is the buyer's responsibility. We work to keep processing and shipping fast, which leaves only a narrow window in which an order can be cancelled or an address changed. Write to support@incendiofirewand.com as soon as you place the order if something needs changing; we will do our best, but the time available to us varies and we cannot guarantee it.

9. Returns

Returns and refunds are governed by our Return Policy.

10. Payment and security

We take all reasonable measures to keep your purchase and payment details secure. Absent negligence on our part, we are not liable for losses you suffer should a third party gain unauthorised access to data you supply while using or ordering from incendiofirewand.com. The site runs industry-standard Secure Sockets Layer (SSL) encryption over personal information such as your name, address and card details.

In buying from us you specifically authorise us to pass on information, including updated information, or to obtain information about you from third parties from time to time - your debit or credit card number and credit reports among them - in order to verify your identity, validate your card, obtain an initial card authorisation and authorise individual transactions.

11. Errors, inaccuracies and omissions

Occasionally the site or the Service may carry a typographical error, an inaccuracy or an omission touching product descriptions, prices, promotions, offers, shipping charges, transit times or availability. We reserve the right to correct these, to change or update information, and to cancel orders where information proves inaccurate - at any time, without prior notice, and including after your order has been submitted. Beyond what the law requires, we take on no duty to update, amend or clarify information, pricing included, and no update or refresh date shown anywhere should be read as meaning every piece of information has been revised.

12. Third-party tools

We may give you access to third-party tools that we neither monitor nor control nor contribute to. Such access is provided "as is" and "as available", without warranties, representations or conditions of any kind and without endorsement, and we carry no liability whatever arising from your use of optional third-party tools. Using them is entirely at your own risk and discretion, and you should satisfy yourself that you know and accept the terms the relevant provider applies. New services and features released through the site in future, including new tools and resources, will likewise fall under these Terms.

13. Comments, feedback and submissions

Comments and complaints are welcome at support@incendiofirewand.com, and we always try to resolve a dispute as quickly as we can.

Where you send us submissions such as photographs or video - at our invitation or on your own initiative, online, by email, by post or otherwise ("comments") - you agree that we may edit, copy, publish, distribute, translate and otherwise use them in any medium, at any time and without restriction. We are under no obligation to hold comments in confidence, to pay for them, or to reply to them.

We may, without being obliged to, monitor, edit or remove anything we judge in our sole discretion to be unlawful, offensive, threatening, libellous, defamatory, pornographic, obscene or otherwise objectionable, or to infringe anyone's intellectual property or these Terms.

Your comments must not infringe any third-party right, including copyright, trademark, privacy or personality rights, and must not be libellous, abusive, obscene or otherwise unlawful, nor carry any virus or malware capable of affecting the Service or a related website. Using a false email address, posing as somebody else, or otherwise misleading us or others about where a comment came from is not permitted. You alone are responsible for your comments and for their accuracy; we accept no responsibility or liability for comments posted by you or by any third party.

Personal information submitted through the store is handled in accordance with our Privacy Policy.

15. Private Circle membership

Private Circle is an invitation-only programme built to give our customers a better shopping experience and access to benefits reserved for members, namely:

• exclusive discounts across every product in the store;
• priority processing of orders;
• high-priority customer service.

Free trial and billing. Private Circle opens with a free one-month trial. Nothing is charged when you join. Your first payment of $39.99 is taken one month after enrolment, from the payment card you supplied at that point, and the membership then renews automatically once a month at the same price until you cancel. Membership is activated as soon as it is confirmed, so every benefit listed above is available to you from the first day, the free month included.

Cancellation. You may cancel whenever you like, by emailing our support address or using the form on our website. No cancellation fee applies. Cancel at any point during the free first month and you are charged nothing at all. To stop any later payment, cancel at least 24 hours before the renewal date concerned.

16. Limitation of liability and waiver

We do not guarantee, represent or warrant that your use of the Service will be uninterrupted, timely, secure or error-free, nor that results obtained from it will be accurate or reliable. You accept that we may withdraw the Service for indefinite periods or cancel it at any time without notifying you.

IFW disclaims liability for loss, injury, claim or damage connected with the use of its products and services, including anything arising from errors or omissions, from a site or application being unavailable, from data loss, or from an aesthetic outcome that disappoints. IFW will not be liable for indirect, incidental, consequential, reliance or special damages, damages arising from court action or legal dispute included. In no circumstances will the total liability of IFW - in contract, warranty, tort (whether negligence is active, passive or imputed), product liability, strict liability or any other theory - arising from or relating to the use of its products or services exceed the limits the law allows.

I confirm that I have read and understood this waiver and have been fully informed of the terms, conditions, benefits and limitations applying to IFW. I confirm that I have disclosed any condition, medical, physical or otherwise, capable of affecting me or my health, and I take responsibility for the way products bought from IFW may affect me and my health, side effects and injuries included. I release IFW from responsibility for injury or complication arising from an undiagnosed condition present while its products are used, and I take full responsibility for keeping it informed of changes in my physical and mental condition.

17. General

• These Terms may be changed by us at any time. Should any provision prove invalid or unenforceable, the rest continues in full force.
• We are not answerable to you for delay in, or failure of, performance of our obligations where the cause lies beyond our reasonable control.
• If you breach these Terms and we do not act, our rights and remedies remain available to us in other situations where you are in breach.
• IFW may amend, remove or vary the Services, or any page of this website, at any time and without notice.

18. Entire agreement and governing law

A failure on our part to exercise or enforce any right or provision of these Terms does not waive that right or provision. These Terms make up the entire agreement between us and supersede every earlier or contemporaneous agreement between you and IFW. A waiver of any provision is effective only if it is in writing and signed by a Director of the Company. These Terms, and any separate agreement under which we provide Services to you, are governed by and construed in accordance with the laws of the United States.
